Man Sues CVS For Telling His Wife About Viagra Prescription

posted by Pedro Bartes -

A Long Island, New York man’s taking CVS pharmacy to court because of his Viagra prescription. You see, those little blue pills were supposed to give Michael Feinberg the lift that keeps on giving, but he says they ended up “destroying his marriage” instead.

According to Feinberg, he took his prescription for eight tablets to the pharmacy. As they can run up to $60 apiece, he left the pharmacy tech specific instructions not to put the pills through insurance (he wanted to pay for them out-of-pocket). A few days later, Feinberg’s wife called the same CVS location, and that’s when the Kraken was unleashed.

Apparently, she was checking on a prescription of her own, and the chatty little pharmacy tech decided to start talking about the Viagra her hubby had laid out. Oops. Now, no one’s saying exactly what the actualconflict between the couple was, but perhaps we don’t need charts and graphs. What we DO know is that HIPPA laws were broken because the wife was a “third party” and not involved in the transaction. She had no right to know about her husband’s meds without his consent. That’s why he’s accusing CVS of “negligence” and he’s seeking “unspecified damages” for “genuine, severe mental injury and emotional harm.” The case is now set to go before the Nassau Supreme Court…and that should be fun for the whole family.

Does he have a case?
